The following states the Action Fish policy regarding the product warranty. This product warranty specifically excludes all Action Fish Kayak kits. We want you to enjoy your Action Fish kayak.

LIMITED WARRANTY

This Limited Warranty covers defects in materials and workmanship in boats manufactured by Action Fish kayak. This includes defects in construction and any other defects that may occur under normal use. Action Fish does not warranty and is not responsible for damages caused by misuse, abuse, accidents, the natural breakdown of materials over time, or problems that may be reasonably expected with normal wear or failure to follow boat care instructions.

This Warranty lasts for one(1) year from delivery of the product, as long as the original purchaser, owns the product. Coverage ends if you sell or transfer the product.

You may seek resolution directly from Action Fish. With a warranty claim you may be requested to send photo's of your claim to assist in assessing your claim. Once the claim is assessed you may send the boat, shipping COD, directly to us at:

Please include a cover letter with your name, address, daytime phone number and a brief description of the problem. A copy of your original receipt or proof of purchase may also be required.

The Action Fish Warranty Department will inspect the boat at no charge to you. This may involve sending the boat to be assessed by outside engineering facilities to determine the validity of the claim at no charge to you. If the Warranty Department determines, in its sole discretion, that the boat has a defect covered under this Warranty, we will repair or replace it. If the defective boat is not repairable, we will replace it with a boat of comparable style and construction at our discretion.

This Limited Warranty gives you specific legal rights. You may also have other rights that vary from jurisdiction to jurisdiction.

Limitation of Liability. ACTION FISH KAYAK'S MAXIMUM LIABILITY TO YOU, INCLUDING WITHOUT LIMITATION LIABILITY UNDER ANY EXPRESS OR IMPLIED WARRANTY, IS LIMITED TO THE PURCHASE PRICE YOU PAID FOR THE BOAT. ACTION FISH KAYAK IS NOT LIABLE TO YOU IF IT IS UNABLE TO PERFORM DUE TO EVENTS BEYOND ITS CONTROL, SUCH AS ACTS OF GOD, OR FOR PROPERTY DAMAGE, PERSONAL INJURY, LOSS OF USE, OR OTHER CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES, HOWEVER CAUSED, WHETHER FOR BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, OTHER THAN THOSE DAMAGES WHICH ARE INCAPABLE OF LIMITATION, EXCLUSION OR RESTRICTION UNDER APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW LIMITATION OR EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU IN WHOLE OR IN PART.
